Terms of Service

The Service

Lasting Aftercare provides a managed aftercare communications service to licensed funeral homes: the funeral home enrolls a family once, and we schedule, produce, and mail a twelve-month sequence of physical cards under the funeral home's name, with monthly reporting on the care delivered. Access is granted on a per-account basis following a service agreement (for pilot clients, the Pilot Agreement). Use of the service constitutes acceptance of these terms.

Funeral Home Responsibilities & Consent

The funeral home represents and warrants that, for every family it enrolls, it has a genuine service relationship with that family and the right and any required consent to arrange follow-up condolence communications on its behalf, and that the enrollment information it provides is accurate. The funeral home agrees to promptly relay to us any family request to stop communications.

The funeral home agrees to indemnify and hold Lasting Aftercare harmless from claims arising from a breach of these representations — including claims by individuals who were enrolled without the required relationship or consent.

Acceptable Use

The service may not be used to send communications to individuals who have not consented to receive aftercare from the relevant funeral home, or to send communications that misrepresent the funeral home's identity or relationship with the family. We may suspend accounts that violate this section.

Opt-Outs

Families may stop all communications at any time. Opt-outs are honored immediately and permanently; cards already in physical production may still be delivered.

Disclaimer of Warranties

The service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee uninterrupted availability or that every mailing will be delivered by the postal service on a particular date.

Limitation of Liability

Lasting Aftercare is not liable for indirect, incidental, or consequential damages arising from use of the service. Our total liability is limited to the fees paid in the 30 days preceding the claim.

Termination

Either party may terminate with 30 days' written notice. We may suspend or terminate an account immediately for material breach of these terms, including the Acceptable Use section. Upon termination, scheduled mailings stop, and account data is handled per our Privacy Policy retention terms.

Changes to These Terms

We may update these terms from time to time. Material changes will be communicated to account holders by email at least 14 days before they take effect; continued use after that date constitutes acceptance. The "Last updated" date above always reflects the current version.

Governing Law

These terms are governed by the laws of the State of Florida, without regard to its conflict of laws principles. Any disputes will be resolved in the state or federal courts located in Florida.
